1. Acceptance of Terms
By accessing or using Instoly (instoly.com), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our service.
2. Description of Service
Instoly is a creator engagement platform that allows creators to set up Direct Message (DM) responses triggered by specific keywords in their Instagram post comments. The service includes:
- Instagram account connection via OAuth
- Mobile number verification and sign-in using one-time passcodes
- Keyword-based comment monitoring
- DM sending and engagement
- Analytics and performance tracking
- Affiliate link management
3. Account Requirements
- You must be at least 13 years old to use Instoly
- You must have an Instagram Business or Creator account
- You must provide a valid mobile number and verify it to create and access your account
- One Instoly account per mobile number
- You are responsible for maintaining the security of your account
- You must not share your account credentials with others
- One Instoly account per Instagram account
4. Acceptable Use
You agree not to use Instoly to:
- Send spam, unsolicited messages, or misleading content
- Violate Instagram's Terms of Use or Community Guidelines
- Harass, abuse, or send threatening messages
- Promote illegal activities or substances
- Attempt to circumvent Instagram's rate limits or messaging policies
- Impersonate another person or entity
- Collect personal data of Instagram users without consent
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Instagram API Compliance
Instoly operates within the boundaries of Meta's Platform Policies and Instagram's API Terms. Key limitations include:
- 24-Hour Window:DMs can only be sent within 24 hours of a user's interaction (comment, DM, etc.)
- Rate Limits: A maximum of 200 messages per hour per Instagram account
- Content Rules: All messages must comply with Instagram's messaging policies
6. Mobile Number Verification and Messaging
A verified mobile number is required to create and access an Instoly account. By providing your number, you agree that:
- We may send you one-time passcodes over WhatsApp to verify your number and to confirm your sign-ins
- You are the authorised user of the number you provide, and you will keep it up to date
- Message and data charges from your mobile or internet provider may apply
- These are service messages required to operate your account, not marketing messages. We may add SMS as an alternative delivery channel in future
You may choose to trust a device so that you are not asked for a passcode on every sign-in. You can revoke trusted devices at any time from your settings. You are responsible for keeping access to your mobile number secure, as it can be used to sign in to your account.
7. Fees and Payment
Instoly offers both free and paid plans. By subscribing to a paid plan, you agree to pay the applicable fees. We reserve the right to change pricing with 30 days' notice. Refunds are handled on a case-by-case basis.
8. Intellectual Property
The Instoly platform, including its design, code, logos, and content, is owned by Instoly and protected by intellectual property laws. You retain ownership of any content you create using our service (message templates, flow configurations, etc.).
9. Limitation of Liability
Instoly is provided "as is" without warranty of any kind. We are not liable for:
- Interruptions in Instagram's API service
- Messages not delivered due to Instagram's policies or rate limits
- Verification passcodes delayed or not delivered by WhatsApp, your network operator, or your device
- Loss of revenue from service interruptions
- Changes to Meta's or Instagram's platform policies
10. Termination
You may cancel your account at any time. We may terminate or suspend your account if you violate these terms. Upon termination, we will delete your data in accordance with our Privacy Policy.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
